By accessing or using the Site, placing an order, or engaging our services, you ("you" or "User") agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Site or our services.

By using this Site, you represent that you are at least eighteen (18) years old (or the age of majority where you live), have the legal capacity to enter a binding contract, will comply with all applicable laws, and that all information you provide is accurate, current, and complete.

We may refuse service, terminate accounts, or cancel orders at our sole discretion, including for suspected fraud, violation of these Terms, or unlawful activity.

We may modify these Terms at any time without prior notice. Changes take effect immediately upon posting, and the "Last Updated" date will be revised. Your continued use of the Site after changes constitutes acceptance. If you do not agree to the updated Terms, discontinue use of the Site.

3.1 License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Site for personal, non-commercial purposes.

3.2 Prohibited Conduct. The name "Mrs. Sweet Strong" and related logos and product/service names are our trademarks and may not be used without our prior written consent.

You may view, download, and print Content solely for personal, non-commercial use, provided you do not modify it and you retain all proprietary notices. Any other use — reproduction, modification, distribution, republication, or display — requires our express written permission.

5.1 Availability. All products are subject to availability. Many items are seasonal and rotate based on availability and inspiration. We may discontinue any product at any time and are not obligated to fulfill requests for products that are not currently available or in season.

5.2 Made Fresh to Order. Our baked goods (cookies, quiche, pastries, and similar items) are made fresh to order. We do not keep an inventory of pre-made products. Some orders require advance notice; standard processing times are communicated at checkout. At checkout you must select your quantity, options, and either in-person pickup or delivery (where available).

5.3 Pricing & Errors. All prices are in U.S. Dollars and may change without notice. Product descriptions, images, and pricing are for informational purposes and may contain errors. If we discover a pricing error on your order, we will notify you and let you either proceed at the correct price or cancel for a full refund; if we cannot reach you, the order is canceled and refunded. Prices exclude applicable taxes and any delivery fees, which are added at checkout.

5.4 Order Confirmation Is Not Acceptance. After ordering, you will receive a confirmation email acknowledging receipt. This is not acceptance of your order. We may accept or decline any order for any reason, including unavailability, pricing or description errors, suspected fraud, inability to verify payment, or failure to meet these Terms. If we decline an order after payment, we will issue a full refund.

5.5 Payment. We accept payment through GoDaddy Payments and other methods shown on the Site. By providing payment information, you represent that you are authorized to use the payment method, that the information is accurate, and that you will pay all charges, including applicable taxes and fees. Payments are processed by a third-party processor; we do not store your complete payment card information.

5.6 Taxes. You are responsible for all applicable sales, use, or other taxes, calculated and added at checkout based on your pickup or delivery location.

Because these items are perishable and made fresh to order:

6.1 All Sales Final. All sales of baked goods are final. Refunds, returns, exchanges, and cancellations are not guaranteedand are granted, if at all, solely at our discretion on a case-by-case basis. Nothing in these Terms entitles you to a refund.

6.2 Cancellation Requests. If you wish to cancel, contact us immediately. Orders that have not yet entered production may, at our discretion, be eligible for cancellation. Once an order is in production or completed, it is generally not eligible for cancellation or refund.

6.3 Quality Concerns. If an item arrives damaged or materially different from what you ordered, contact us within twenty-four (24) hours of pickup or delivery with your order number, a description of the issue, and photographs. At our sole discretion, we may offer a replacement, a partial or full refund, or store credit. We may require inspection of the product first.

6.4 No Refunds for Preference. We do not refund or replace products based on taste or other subjective preferences. If you are unsure about a flavor, please ask us or visit us in person before ordering.

7.1 Quote Request, Not an Order. Custom cakes are made to order and begin with a request submitted through our Site (event date, size, flavor, filling, frosting, design description, dietary needs, and any reference photos). Submitting the contact form is a request for a quote only — it is not an order and creates no obligation or payment. We aim to respond within twenty-four (24) hours (or the next business day) with pricing, availability, and any questions.

7.2 Advance Notice. Custom cake orders require a minimum of seven (7) days' advance notice before the requested event/pickup date. We may decline requests submitted with less notice. Rush orders, if accepted, are at our discretion and may incur an additional fee.

7.3 Deposit & Payment. To confirm a custom cake order, you must pay a deposit equal to fifty percent (50%) of the total order price. Your order is not confirmed and your date is not reserved until the deposit is received. You may cancel and receive a full refund of the deposit only if you notify us within seventy-two (72) hours of paying it. After that 72-hour window, the deposit is non-refundable. The remaining fifty percent (50%) balance is due at pickup or delivery.

7.4 Pricing. Custom cake pricing is determined case-by-case based on size and servings, design complexity, flavors and specialty ingredients, and any dietary or special requests. Any starting prices shown on the Site are estimates; final pricing is provided before your order is confirmed.

7.5 Design & Specifications. We make reasonable efforts to match your description and reference photos, but cakes are handmade and slight variations in color, design, and decoration may occur. We will not replicate copyrighted or trademarked designs without proper authorization, and we may decline any request that is not feasible or appropriate.

7.6 Changes. Requested changes (size, design, flavor, date, etc.) must be made as soon as possible and are subject to our approval. Changes requested within forty-eight (48) hours of pickup/delivery may not be possible and may incur additional charges.

7.7 Cancellations & No-Shows. After the 72-hour deposit window, your deposit is forfeited if you cancel. If you fail to pick up your cake at the scheduled time without prior arrangement, the order is considered abandoned, your deposit will not be refunded, and the cake will not be remade or rescheduled.

8.1 Pickup. We will notify you when your order is ready. Pickup is available at Lovelaceville Gather, 5965 Lovelaceville Rd, Paducah, KY [VERIFY ZIP], during business hours (Tuesday–Friday 7:00 AM–5:00 PM, Saturday 9:00 AM–3:00 PM). You must pick up your order by the scheduled date and time; failure to do so may result in cancellation without refund.

8.2 Delivery (Where Available). Any delivery fees are calculated at checkout. Delivery times are estimates and not guaranteed, and we are not responsible for delays beyond our control. You must provide accurate delivery information; we are not responsible for orders delivered to an incorrect address you provided. By selecting delivery, you authorize us to leave the order at the address if no one is available to accept it, and we are not responsible for products lost, stolen, or damaged after delivery.

Our products are made in a facility that uses common allergens, including wheat (gluten), eggs, dairy, nuts (tree nuts and peanuts), and soy. Cross-contamination may occur, and we cannot guarantee that any product is free from allergens.

If you have a food allergy or dietary restriction, it is your responsibility to inform us before ordering, review ingredients and descriptions carefully, and understand that we cannot guarantee an allergen-free environment. To the fullest extent permitted by law, we are not liable for allergic reactions or adverse health effects from consuming our products, and by ordering you acknowledge and accept this risk.

10.1 Disclaimer of Warranties. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS, SERVICES, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10.2 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MRS. SWEET STRONG LLC AND ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, PRODUCTS, OR SERVICES, OR TO ANY HEALTH-RELATED ISSUE ARISING FROM CONSUMPTION OF OUR PRODUCTS.

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Mrs. Sweet Strong LLC and its owners, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, products, or services; your violation of these Terms; your violation of any third-party rights; any false or misleading information you provide; or your negligent or wrongful conduct. This obligation survives termination of these Terms.

12.1 Governing Law. These Terms are governed by the laws of the State of Kentucky and the United States, without regard to conflict-of-law principles.

12.2 Venue. Any legal proceeding relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in McCracken County, Kentucky, and you consent to those courts' jurisdiction and venue.

12.3 Informal Resolution First. Before filing any claim, you agree to first attempt to resolve the dispute informally by contacting us at [INSERT EMAIL/PHONE]. We will work in good faith to resolve it within thirty (30) days.

12.4 Binding Arbitration & Class Waiver. If informal resolution fails, you agree to binding arbitration under the rules of the American Arbitration Association, conducted in McCracken County, Kentucky, or remotely by video. The arbitrator's decision is final. YOU AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. Either party may still seek injunctive relief in court to protect intellectual property or prevent unauthorized use of the Site.

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms or fraudulent, abusive, or illegal activity. Provisions that by their nature should survive termination — including intellectual property, indemnification, limitation of liability, and dispute resolution — will survive.

14.1 Severability. If any provision is found invalid or unenforceable, the remaining provisions stay in effect, and the invalid provision will be modified only to the minimum extent needed to make it enforceable.
